Welcome to Share with Fare. By accessing or using sharewithfare.com or our mobile application, you agree to be legally bound by these Terms and Conditions (“Terms”). These Terms constitute a binding legal agreement between you and Dream Vista Private Limited (“Company,” “we,” “us,” or “our”), registered under the Companies Act, 2063 of Nepal. If you do not agree, please discontinue use of the platform immediately.
1. PLATFORM OVERVIEW AND LEGAL STATUS
Share with Fare is a digital marketplace and facilitation platform operating under the E-Commerce Act, 2081 (2025), the Electronic Transactions Act, 2063 (2008), and the Consumer Protection Act, 2075 (2018) of Nepal. The platform connects Owners who wish to list items for short-term rental with Renters seeking to rent those items.
The Company acts solely as an intermediary and digital marketplace facilitator. It does not own, inspect, store, warrant, or insure any listed item. Rental agreements are formed directly between Owners and Renters. However, the Company is responsible for payment facilitation, platform security, and user dispute support as described herein.
Applicable laws include: Companies Act 2063, E-Commerce Act 2081, Electronic Transactions Act 2063, Consumer Protection Act 2075, Contract Act 2000, National Civil Code 2074, Individual Privacy Act 2075, Income Tax Act 2058, and VAT Act 2052.
2. ELIGIBILITY AND ACCOUNT REGISTRATION
2.1 Eligibility
To use Share with Fare, you must:
- Be at least 18 years of age;
- Be a natural person with legal capacity to enter into a binding contract under the Contract Act, 2000 of Nepal;
- Hold a valid government-issued identity document (Citizenship Certificate, Driving License, Passport, or National ID);
- Possess a valid Nepal Rastra Bank (NRB)-compliant payment account or digital wallet (eSewa, Khalti, IME Pay, or bank account);
- Comply with all applicable laws of Nepal.
Persons under 18 may not create accounts or engage in transactions on the platform.
2.2 Account Registration and KYC
All users must complete registration and identity verification (KYC) prior to listing or booking. Required documents include:
- Government-issued Citizenship Certificate, Passport, Driving License or National ID;
- A valid mobile number and email address;
- For vehicle listings: valid Blue Book with current renewal;
- For machinery or heavy equipment: proof of ownership and relevant permits where applicable.
The Company may reject or suspend any account that fails KYC or provides inaccurate information.
3. TERMS FOR OWNERS (ITEM PROVIDERS)
3.1 Listing Items
Owners must ensure:
- All listings include accurate, complete, and current descriptions, pricing, availability, and photographs;
- Items are legally owned, fully functional, safely maintained, and comply with all applicable Nepali regulations;
- Vehicle listings include valid Blue Books with current registration renewal;
- Listings do not contain misleading, fraudulent, or prohibited content;
- Items are not stolen, under lien, or subject to any third-party claims;
- Availability calendars are kept up to date at all times.
The Company may approve, reject, modify, or remove any listing that violates these Terms, applicable law, or platform standards without prior notice.
3.2 Pricing and Commission
Owners set their own rental prices. The Company charges a platform commission of 5% (inclusive of applicable VAT) on each successfully completed booking. This commission is automatically deducted from the booking amount prior to payout.
Commission rates may be revised with 30 days’ prior notice to registered Owners. Continued use of the platform after the notice period constitutes acceptance of the revised rate.
3.3 Payouts
After deduction of the 5% platform commission, payouts are processed via:
- Digital wallets: eSewa, Khalti, or IME Pay;
- Direct bank transfer to a Nepal-registered bank account.
Payouts are initiated within 3–5 business working days following confirmed booking completion and satisfactory item return. Payouts may be withheld pending resolution of active disputes or policy violations. Tax obligations on rental income remain the sole responsibility of the Owner under the Income Tax Act, 2058.
3.4 Booking and Payment
All bookings must be paid in full at the time of reservation. Payments are made via QR code to Dream Vista Private Limited. No payment is released to the Owner until booking completion is confirmed. Off-platform payments are not recognised or enforced by the Company.
3.5 Owner Cancellations
Owners may cancel bookings only for legitimate, documented reasons (e.g., item damage, force majeure). Upon Owner cancellation:
- The Renter receives a full refund;
- The Owner must notify the Renter and the Company promptly;
- Repeated or unexplained cancellations may result in listing suspension, account restriction, or permanent deactivation.
3.6 Damage, Liability, and Insurance
- Share with Fare does not provide insurance or theft protection for any listed item. Owners of high-value assets are strongly advised to obtain independent commercial insurance;
- Owners may collect a refundable security deposit from Renters, as clearly stated in the listing;
- Damage disputes must be reported to the platform within 24 hours of item return, supported by photographic evidence;
- The Company may assist in communication between parties but is not liable for damage settlements or outcomes.
3.7 Owner Conduct
Owners must:
- Respond to booking requests within the platform’s stated response window;
- Be punctual, respectful, and honest in all platform communications;
- Maintain confidentiality of Renter personal information;
- Comply with all applicable local, provincial, and federal laws of Nepal.
False listings, failure to deliver, fraudulent conduct, or repeated misconduct will result in immediate account deactivation and may be reported to relevant authorities.
3.8 Tax Obligations and TDS
Dream Vista Private Limited is legally required under Section 88 and Section 89 of the Income Tax Act, 2058 to deduct Tax at Source (TDS) from all Owner payouts before disbursement. The applicable TDS rates are 15% for individual Owners, 1.5% for VAT-registered vehicle Owners, and 1.5% for registered company Owners on payouts exceeding NPR 50,000. Owners without a valid PAN will have 25% TDS deducted. TDS deducted is deposited with the Inland Revenue Department (IRD) of Nepal on behalf of the Owner. Owners may claim the TDS amount as advance tax credit in their annual income tax return by using the Payout Settlement Statement issued by Dream Vista.
3.9 Payout Settlement Statement
Dream Vista will issue a Payout Settlement Statement to each Owner upon every completed payout. This document serves as: (a) the Owner’s official income record for the transaction, (b) a TDS certificate showing the amount deducted and deposited with IRD, and (c) proof of commission deducted by the platform. Owners must not issue separate invoices to Renters for bookings facilitated through the platform. The Payout Settlement Statement is the sole income document for platform-facilitated rentals.
3.10 PAN Requirement
All Owners must provide a valid Permanent Account Number (PAN) issued by the Inland Revenue Department of Nepal prior to listing approval. Failure to provide a PAN will result in a higher TDS deduction of 25% on all payouts. Dream Vista will not be liable for higher TDS deductions resulting from an Owner’s failure to submit their PAN.
4. TERMS FOR RENTERS (GUESTS)
4.1 Booking and Payment
To complete a booking, Renters must:
- Provide accurate and complete personal and booking information;
- Complete the required KYC verification process;
- Pay the full booking amount in advance via QR code to Dream Vista Private Limited using a supported payment method (eSewa, Khalti, IME Pay, or bank transfer);

- Download the QR ticket generated upon booking confirmation for use at pickup.
A booking is confirmed only after full payment is verified by the Company. Unverified or partial payments do not constitute a confirmed booking.
4.2 Use and Return of Items
Renters agree to:
- Inspect items at pickup and report any pre-existing damage before use;
- Use rented items responsibly, lawfully, and only for the stated purpose;
- Return items in the same condition as received, on or before the agreed return date and time;
- Not sub-rent, lend, or allow third parties to use rented items without express Owner consent;
- Bear full liability for any damage, loss, or theft occurring during the rental period.
4.3 Cancellations and Refunds
- Cancellation at least 12 hours before rental start: Full refund;
- Cancellation within 12 hours of rental start: 20% deduction; 80% refunded;
- No-show without prior cancellation: No refund issued.
Refunds are processed to the original payment method within 3–7 business working days of cancellation confirmation. In cases of Owner-initiated cancellation, Renters are entitled to a full refund within 3 business days.
4.4 Late Returns
- Renters must notify the Owner and Company as early as possible if a delay is anticipated;
- Late return charges are calculated at a pro-rated daily or hourly rate as determined by the Owner and stated in the listing;
- Extended use without Owner approval may be treated as unlawful possession and escalated to appropriate authorities.
4.5 Disputes
All disputes must be reported to the platform within 24 hours of item pickup or return:

Provide supporting evidence (photographs, receipts, communications). The Company will facilitate communication and may offer mediation. Unresolved disputes may be submitted to the Consumer Dispute Resolution Committee under the Consumer Protection Act, 2075.
4.6 Reviews and Feedback
After completing a rental, both Owners and Renters are encouraged to post honest and fair reviews on the respective listing page. Reviews must be factual, relevant, and respectful. The Company may remove reviews that are fraudulent, defamatory, or violate community standards.
4.7 Booking Receipt
Upon confirmed payment, Dream Vista will issue an official Booking Receipt (PAN Bill) to the Renter. This receipt is the valid proof of transaction and must be presented at item pickup. The receipt number follows the format SWF-R-[FY]-[Serial Number]. Renters should retain this receipt for the duration of the rental period.
4.8 VAT Notice
Share with Fare is currently registered under PAN only (PAN: 619792224) and is not VAT registered. No VAT is charged on transactions. When the platform becomes VAT registered, a 13% VAT will be applied on the platform service fee component only (not on the full rental amount), and all invoices will be updated accordingly with the VAT registration number.
5. PAYMENTS, TAXES, AND FINANCIAL COMPLIANCE
All payments are processed exclusively through Dream Vista Private Limited via QR code. Accepted methods include eSewa, Khalti, IME Pay, and direct bank transfer. The Company complies with applicable Nepal Rastra Bank (NRB) payment regulations and the Electronic Transactions Act, 2063. All payment gateways used are NRB-licensed.
Users are solely responsible for any taxes arising from their platform activity. The Company will issue invoices or receipts upon request.
6. Electronic Transactions and Digital Records
All booking receipts, payout statements, and transaction records generated through the Share with Fare platform are valid electronic documents under the Electronic Transactions Act, 2063 (2008) of Nepal. These documents are legally equivalent to physical paper documents for the purposes of taxation, dispute resolution, and regulatory compliance. The platform maintains digital records of all transactions for a minimum of 5 years as required by the Income Tax Act, 2058. Users may request copies of their transaction records by contacting support@sharewithfare.com.
7. WooCommerce and Online Booking Data
Booking and payment data processed through the platform’s WooCommerce-based booking system is subject to this Agreement and the Privacy Policy. Order data including renter details, item details, rental dates, and payment amounts are stored securely and used solely for fulfilling rental transactions, processing payouts, and tax compliance. Renter data is never shared with Owners beyond what is necessary to complete the rental (first name, item pickup details). Full contact information sharing requires mutual consent through the platform.
8. Invoice Numbering and IRD Compliance
All receipts and invoices issued by Dream Vista Private Limited follow a sequential numbering system as required by the Inland Revenue Department of Nepal. Receipt numbers follow the format SWF-R-[FY]-[XXXX] for Renter Receipts and SWF-P-[FY]-[XXXX] for Owner Payout Statements. These numbers are never repeated or skipped. Any attempt by users to present forged, altered, or duplicate receipts constitutes fraud and will be reported to relevant authorities.
9. INTELLECTUAL PROPERTY
All content on Share with Fare — including the website, application, brand name, logo, design, text, graphics, and software — is the proprietary property of Dream Vista Private Limited, protected under Nepal’s Copyright Act, 2059 and the Patent, Design and Trademark Act, 2022.
Users grant the Company a non-exclusive, royalty-free licence to display and use content they upload (photographs, descriptions) for the purpose of operating and promoting the marketplace. This licence terminates when the content is permanently removed.
Unauthorised reproduction, distribution, or commercial use of any platform content is strictly prohibited.
10. PROHIBITED CONDUCT
Users must not:
- Create false, misleading, or duplicate accounts;
- List stolen, counterfeit, or illegally obtained items;
- Use rented items for illegal purposes;
- Conduct or solicit off-platform payments to circumvent platform fees;
- Harass, threaten, or engage in discriminatory conduct toward other users;
- Submit fraudulent payment receipts or identity documents;
- Scrape, reverse-engineer, or attempt unauthorised access to platform systems;
- Engage in any activity constituting a cyberoffence under the Electronic Transactions Act, 2063.
Violations may result in account suspension, withholding of payouts, and/or referral to law enforcement.
11. LIMITATION OF LIABILITY
The Company operates as a digital marketplace facilitator only and does not warrant or guarantee any rental transaction. To the fullest extent permitted by Nepali law, the Company is not liable for:
- Personal injury, property damage, or financial loss from rental transactions;
- Acts or omissions of Owners or Renters;
- Item damage, theft, or loss during the rental period;
- Platform downtime, data loss, or technical failures;
- Third-party payment gateway failures or delays;
- Force majeure events.
The Company’s maximum aggregate liability to any user shall not exceed the total platform fees collected from that user in the preceding 3 months.
Nothing in these Terms limits liability that cannot be excluded under the Consumer Protection Act, 2075, or any other mandatory provision of Nepali law.
12. ACCOUNT SUSPENSION AND TERMINATION
The Company may suspend or permanently deactivate any account for:
- Violation of these Terms;
- Fraudulent, abusive, or illegal conduct;
- Identity fraud or KYC misrepresentation;
- Repeated cancellations or non-performance.
Users may appeal suspensions by writing to support@sharewithfare.com within 14 days of notification. Users wishing to close their accounts must resolve all pending transactions and obligations first.
13. AMENDMENTS
The Company may amend these Terms at any time, with at least 14 days’ notice to registered users via email or platform notification. Material changes affecting user rights or financial obligations will be communicated with at least 30 days’ notice. Continued use after the effective date constitutes acceptance.
14. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of Nepal, including the Constitution of Nepal 2015, Companies Act 2063, Contract Act 2000, National Civil Code 2074, Consumer Protection Act 2075, Electronic Transactions Act 2063, E-Commerce Act 2081, Individual Privacy Act 2075, Income Tax Act 2058, and VAT Act 2052.
Disputes shall first be subject to good-faith negotiation. If unresolved, they may be referred to mediation or to the competent courts of Nepal. Consumer-related disputes may also be submitted to the Consumer Dispute Resolution Committee under the Consumer Protection Act, 2075.
